Dr. Biserni Andrea — Psicologo Psicoterapeuta Sessuologo

Terms of sale

The conditions an order is placed under, with the parts that cost money or delay a parcel kept at the top.

These terms govern any order placed through the pharmacy catalogue. They are written to be read, not to be survived, so the parts that cost money or delay an order are at the top.

1. Who you are dealing with

Your contract is with the Studio di Psicologia, Psicoterapia e Sessuologia del Dr. Biserni Andrea, Via Pian di Guido 6, 52036 Pieve Santo Stefano (AR), Italy, Italian VAT number IT01830230510, contactable at [email protected] and on +39 347 445 4271, Monday to Friday between 9:00 and 19:00 Italian time. Fuller detail, including the registration you can verify, is on who we are.

2. How an order is actually formed

Adding a product to the basket, or sending a request by email, is an offer from you. It does not create a contract and does not reserve stock. The sequence is:

  1. you send the request, with a prescription where one is required;
  2. a pharmacist checks it against the product, the strength and the quantity;
  3. you receive a written confirmation naming the exact product, strength, pack size, quantity and the total you will pay;
  4. payment is arranged against that confirmation;
  5. the order is dispatched.

The contract comes into being at step three, on the terms of that confirmation. Until then either side can walk away at no cost, including you.

3. Prices

Prices on the product pages are in US dollars and are indicative: they are per pack, they fall as the pack grows, and they can change without notice until a confirmation has been issued. The figure in your written confirmation is the figure you pay, and it does not move afterwards — not for a currency shift, not for a price revision, not for a courier surcharge.

What the figure does not include is any import duty, customs charge, local sales tax or handling fee raised in the country of delivery. Those are set by your own authorities, are payable by the recipient, and are outside our control. No charge is made for the pharmacist review itself. There are no subscriptions, no auto-renewals and no recurring payments of any kind: every order is a separate transaction that you start.

4. Payment

No card number is entered on this website and no card details are stored by us. Payment is arranged against the written confirmation, and nothing is taken before the prescription check has cleared. If a check does not clear, there is nothing to refund because nothing was charged.

5. Prescription-only items

Seventy of the products in the catalogue are prescription-only. For those, a valid prescription from a licensed prescriber is a condition of supply and not a formality to be completed later: the order is held until the prescription has been received and read, as described on the prescription service page. A prescription that has expired, that names a different strength or quantity, that has already been dispensed in full elsewhere, or that cannot be read, does not release an order. Nothing is substituted to make an order work — a prescription for 50 mg does not release the 100 mg pack, and a prescription for thirty tablets does not release a box of 360.

6. What you confirm when you order

  • that you are at least 18 years old;
  • that the medicine is for you, or for the person named on the prescription, and that the delivery address is yours or one they have agreed to;
  • that the information you give — name, address, prescription, current medication where you tell us about it — is accurate;
  • that you have checked whether the medicine may lawfully be imported into the country of delivery. Rules on personal imports of prescription medicines differ sharply from one country to another, some permit a limited quantity for personal use and others permit none, and the obligation to know which applies to you cannot be transferred to us. A parcel seized or returned by customs is treated under section 8.

7. When we refuse or hold an order

An order is held, or refused outright, if the prescription does not match the request, if the documents suggest the medicine is not for the person named, if the combination requested is one the label warns against — a nitrate alongside a PDE5 inhibitor is the clearest case and it is stopped rather than flagged — if the quantity goes beyond what the prescription covers, or if supply to the destination would be unlawful. You are told the reason. A refusal is not a judgement about you, and it carries no charge.

8. Cancelling, and the limits of the right of withdrawal

Before dispatch you can cancel any order for any reason, without giving a reason, by email: nothing has been charged, so there is nothing to recover.

After dispatch the position changes, and it changes for a reason that is not commercial. Sealed medicinal products are among the goods excluded from the consumer right of withdrawal once they have been unsealed, under article 16(e) of Directive 2011/83/EU and article 59 of the Italian Consumer Code, because a medicine that has left a pharmacy’s control cannot be verified or resold safely. A dispensed medicine is therefore not returnable for a change of mind. What remains fully available to you is everything that concerns our performance rather than your preference: a parcel that arrives damaged, incomplete, wrong, or not at all is replaced or refunded in full. That is set out, with the evidence we need and the time limits, in returns and refunds.

9. Delivery

Dispatch and delivery, including what happens to a parcel that is delayed, undeliverable or stopped in customs, are covered on shipping and delivery. The delivery window for your address is stated in the written confirmation rather than promised in advance on this page.

10. What we are responsible for, and what we are not

We are responsible for supplying the medicine named in your confirmation, in the strength and quantity confirmed, sealed and within date, and for correcting it at our cost if we get that wrong. We are not responsible for the clinical decision that led to the prescription, which belongs to the prescriber, nor for a reaction to a correctly supplied medicine used as the label directs, nor for charges raised by your own customs authority, nor for a delay caused by a carrier once the parcel has left. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or any other liability that cannot lawfully be limited.

11. Information on this site

Product pages reproduce the regulator-approved labelling and are sourced as described in how we source our information. They are not a prescription, not a diagnosis and not advice about whether a medicine suits you. No prescription is issued by this service.

12. Data, complaints, governing law

How order and prescription data are handled is set out in privacy and your data. Complaints start at the email address in section 1; the external routes — pharmacovigilance, professional conduct, data protection — are listed on who we are and medicine safety. These terms are governed by Italian law. If you are a consumer, the mandatory consumer protections of your country of residence are unaffected, and you may sue or be sued in the courts of your own place of residence.

If these terms change, the version on this page is the one that applies to orders placed after it appeared; an order already confirmed keeps the terms in force when it was confirmed.
